Israeli response to Vatican recognition of PA as a state

Israel cannot accept the unilateral determinations in the agreement which do not take into account Israel’s essential interests and the special historic status of the Jewish people in Jerusalem.

The Israel Ministry of Foreign Affairs expresses its regret regarding the Vatican decision to officially recognize the Palestinian Authority as a state, in the agreement signed on Friday (June 26, 2015). This hasty step damages the prospects for advancing a peace agreement and harms the international effort to convince the PA to return to direct negotiations with Israel.

We also regret the one-sided texts in the agreement which ignore the historic rights of the Jewish people in the Land of Israel and to the places holy to Judaism in Jerusalem. Israel cannot accept the unilateral determinations in the agreement which do not take into account Israel’s essential interests and the special historic status of the Jewish people in Jerusalem.

Israel will study the agreement in detail, and its implications for future cooperation between Israel and the Vatican.

Israeli response to the UNHRC Commission of Inquiry

It is regrettable that the report fails to recognize the profound difference between Israel’s moral behavior during Operation Protective Edge and the terror organizations it confronted. This report was commissioned by a notoriously biased institution, given an obviously biased mandate.
The 2014 Gaza Conflict: Factual and Legal Aspects – The Full Report

Israel is studying the Commission of Inquiry Report (COI) from the United Nations’ Human Rights Council (UNHRC). However, some initial comments can be made about the COI process in general:

1) It is well known that the entire process that led to the production of this report was politically motivated and morally flawed from the outset. Just as Israel seriously considered every complaint, no matter its origin, it will also seriously study this report. We take note of the fact that the authors of this report admitted that they lacked much of the relevant information.

It is regrettable that the report fails to recognize the profound difference between Israel’s moral behavior during Operation Protective Edge and the terror organizations it confronted.

2) This report was commissioned by a notoriously biased institution, given an obviously biased mandate, and initially headed by a grossly biased chairperson, William Schabas. The UNHRC has a singular obsession with Israel, passing more country specific resolutions against Israel than against Syria, Iran and North Korea combined – in fact, more than against all other countries combined. The commission of inquiry’s mandate presumed Israel guilty from the start and its original chairman, William Schabas, was compelled to resign due to a blatant conflict of interest (paid work for the Palestinians), which he concealed from the United Nations.

3) The COI also lacked the necessary tools and expertise to conduct a professional and serious examination of armed conflict situations.

Israel will consider the report in light of these essential failings. It would encourage all fair-minded observers to do the same.

4) Israel is a democracy committed to the rule of law, forced to defend itself against Palestinian terrorists who commit a double war crime: They indiscriminately target Israeli civilians while deliberately endangering Palestinian civilians, including children, by using them as human shields.

5) In defending itself against attacks, Israel’s military acted according to the highest international standards. This was confirmed by a comprehensive examination by Israeli military and legal experts, as well as reports produced by internationally renowned military professionals.

6) Israel will continue to uphold its commitment to the law of armed conflict despite the brutal tactics of its enemies. Israel will continue to investigate alleged wrongdoing in accordance with international standards and to cooperate with those UN bodies that conduct themselves in an objective, fair and professional manner.

Statement by PM Netanyahu on the UNHRC Commission of Inquiry report

Israel does not commit war crimes. Israel is defending itself from a murderous terrorist organization that calls for its destruction and which has perpetrated many war crimes. We will not sit, and have not sat, idly by.
Israel will continue to uphold its commitment to the laws of armed conflict despite the brutal tactics of its enemies, and it will continue to investigate any allegations of wrongdoing in accordance with highest international standards.

Prime Minister Benjamin Netanyahu, today (Monday, 22 June 2015), at the Knesset, issued the following statement:
“The report on Operation Protective Edge issued by the commission appointed by the UN Human Rights Council is biased. The commission that wrote this report was appointed by a council that calls itself the ‘Human Rights Council.’ In effect, it does everything but look after human rights. This is a body that condemns Israel more than Iran, Syria and North Korea combined. It first appointed to head the commission a man who was caught inciting against the State of Israel and who also took money from the Palestinians. It first began to investigate events in the region from the day after – the day after – the kidnapping of the three youths, who were murdered. It is on this basis that one needs to consider its findings, conclusions and recommendations.
Israel is defending itself and is doing so in accordance with international law. We are not the only ones who say this. Last week we issued a detailed, professional report that evaluated our actions, in accordance with international law, against terrorists that fire at civilians and hide behind civilians. This is also backed up by the report issued by senior US and European generals who claimed, and reached the conclusion, that Israel defended itself in accordance with the standards of international law. But they say, ‘above and beyond’. One of the senior generals said that there is no country that acted like the State of Israel and went beyond the letter of the law to observe international law.
Israel does not commit war crimes. Israel is defending itself from a murderous terrorist organization that calls for its destruction and which has perpetrated many war crimes. Any country that wants to live would have acted this way. But the commission expects a country, the citizens of which have been attacked by thousands of missiles, to sit idly by. We will not sit, and have not sat, idly by. We will continue to take strong and determined action against all those who try to attack us and our citizens, and we will do so in accordance with international law.”

Prime Minister Benjamin Netanyahu issued the following statement today (Monday, 22 June 2015):

The United Nations Human Rights Council has a singular obsession with Israel. It has passed more resolutions against Israel than against Syria, North Korea and Iran combined. In fact, it has passed more resolutions against Israel that against all the countries of the world combined.
So, Israel treats this report as flawed and biased, and it urges all fair-minded observers to do the same. Such fair-minded observers recently investigated Israel’s conduct in the Gaza campaign. They include senior generals from the United States and NATO countries. They found that not only did Israel uphold the highest standards of international law, in the laws of armed conflict, they said that Israel exceeded the highest standards.
Israel will continue to uphold its commitment to the laws of armed conflict despite the brutal tactics of its enemies, and it will continue to investigate any allegations of wrongdoing in accordance with highest international standards.”

Peace will only come from direct negotiations between the parties, without preconditions. It will not come from UN resolutions that are sought to be imposed from the outside. President Abbas believes he can avoid such direct negotiations.

Prime Minister Benjamin Netanyahu, today (Sunday, 21 June 2015), met with French Foreign Minister Laurent Fabius and told him at the start of their meeting:

“Mr. Foreign Minister, the history of the French and Jewish people is long and interconnected. It was the French Revolution that brought about the emancipation of French Jews, and it gained them full civic rights. And Jews began to participate in French life in all areas: In culture and literature, in economics, in politics. We were inspired in many ways by the principles of ‘Liberté, égalité, fraternité.’ Theodor Herzl and the founding fathers of Zionism drew much inspiration from the experience of France.

France was also our closest ally in the formative years of the state. We will never forget the crucial support that was offered to us in times of need. And I believe today France also has a crucial role to play. We urge France to stand firm and prevent a bad deal that will pave Iran’s path to the bomb.

The new US State Department report on Iranian involvement in terrorism is another wake-up call. Iran’s subversion and aggression is rampant, both in and beyond the Middle East. Its terror network now encompasses over 30 countries in many continents. And under the imminent nuclear agreement, Iran will not only receive a clear path to nuclear weapons, it will also receive many, many billions of dollars, enabling it to upgrade its terrorism worldwide and of course its aggression in the region.

Mr. Minister, today in Jerusalem a Palestinian terrorist brutally stabbed a policeman. On Friday a Palestinian terrorist shot dead an Israeli citizen. Not only has the Palestinian Authority refused to condemn these acts of violence, it continues unabashedly with its campaign of incitement against Israel and Israel’s civilians. Official Palestinian propagation of violence and hatred are par for the course. It must be unequivocally condemned by all those who seek to advance peace.

Six years ago at Bar-Ilan University I laid out my vision of peace based on two states for two peoples. In this vision, a demilitarized Palestinian state recognizes the Jewish state. And while I place no conditions on entering talks, I know that the twin foundations of peace are mutual recognition and security. Mutual recognition means that the Palestinians must finally recognize Israel as the nation-state of the Jewish people. I find it frankly inconceivable that while the Palestinians expect us to recognize a Palestinian nation-state, they refuse to accord us the same privilege, recognizing a Jewish nation-state. And if they continue to refuse to recognize the legitimacy of the Jewish state, what kind of peace are they offering us?

I think the other pillar, the need for security, is self-evident for anyone that follows developments in this region. The Middle East is undergoing a period of unprecedented volatility and violence. States that have existed for almost a century are disintegrating before our eyes. And Islamist extremists are rushing to fill up the vacuum. ISIS leads the Sunni radicals. Iran heads the Shiite militants. And Israel faces terrorist armies amassed on our borders in the North and in the South.

A peace that isn’t anchored in iron-clad security arrangements on the ground, in which Israel can defend itself, such a peace will simply not survive and we will not agree to it. Our concerns are not pretexts or excuses. They are genuine. A peace deal that ignores these realities will be swept away by the winds of extremism and violence that blow throughout the Middle East.

Mr. Foreign Minister, peace will only come from direct negotiations between the parties, without preconditions. It will not come from UN resolutions that are sought to be imposed from the outside. President Abbas believes he can avoid such direct negotiations. He wants to avoid the give and take of negotiations. And why does he go that route? Because even though the Palestinians ran away from the negotiations again and again and again, it is Israel that is being blamed.

Last year, the Palestinians slammed the door on Secretary Kerry’s framework for negotiations. They slammed the door on Prime Minister Barak. They slammed the door on Prime Minister Sharon. They slammed the door on Prime Minister Olmert. They slammed the door on me.

They attempt to impose terms on Israel, but they will fail. And this attempt will not merely fail, it will drive peace away. First, Israel will resist the imposition of terms from the outside. And second, the Palestinians will never agree to negotiate if they think the international community will give them what they want without negotiations. I think there is no magic shortcut. Peace demands a commitment to direct negotiations without preconditions. Peace demands a sustained effort to overcome obstacles. I am ready for such an effort.”

The Prime Minister also said: “We’ve been informed by the Government of Egypt that it is dispatching an ambassador to Israel. This is an important piece of news. We appreciate it. It’s something that has been, that is deeply welcomed in Israel and I think it’s very good for cementing the peace that exists between Egypt and Israel.”

Prime Minister Benjamin Netanyahu, this afternoon (Sunday, 15 June 2014), issued the following statement:
“Hamas terrorists carried out Thursday’s kidnapping of three Israeli teenagers. We know that for a fact. These teenagers were kidnapped and the kidnapping was carried out by Hamas members. Hamas denials do not change this fact. And this attack should surprise no one because Hamas makes no secret of its agenda. Hamas is committed to the destruction of Israel and to carrying out terrorist attacks against Israeli civilians – including children.
Instead of abiding by his international obligation to disarm Hamas, President Abbas has chosen to make Hamas his partner. Israel holds the Palestinian Authority and President Abbas responsible for any attacks against Israel that emanate from Palestinian-controlled territory. The Palestinian claim that the Palestinian Authority cannot be held responsible for an attack that took place in an area under Israeli security control is patently absurd.
When an attack takes place in Tel Aviv or in London or in New York – all these places have been attacked by terrorists – the question is not where the attack takes place. The question is where it originated. The kidnappers in this case set out from territory controlled by the Palestinian Authority, and the PA cannot absolve itself of its responsibility.
You remember that Israel warned the international community about the dangers of endorsing the Fatah-Hamas unity pact. I believe that the dangers of that pact now should be abundantly clear to all. We have seen since the signing of that pact an increase in terrorist activity emanating from the West Bank. We have seen Hamas strengthen its presence there, and this increases the likelihood that Hamas will take control of the Palestinian Authority, precisely as it did in Gaza. This will not advance peace; it will advance terror.
Israel will act in all ways under its province, in all ways under our control, to bring home the three kidnapped teenagers. Israel will act against the kidnappers and their terrorist sponsors and comrades. We will do whatever needs to be done to protect our people, our citizens, our children and our teenagers from the scourge of terrorism.

“Over the weekend, the leaders of Hamas reiterated their intention to destroy the State of Israel. Whoever hoped that the Palestinian unity between Fatah and Hamas would moderate Hamas is mistaken. Instead of the Palestinian authority taking over Gaza, the signs are being more and more seen that the complete opposite is taking place, i.e. that Hamas is increasing its control in the Palestinian Authority areas in Judea and Samaria. Therefore, international pressure must be applied on Abu Mazen to dissolve the partnership with Hamas. This touches on the roots of the conflict and the roots of a solution in which peace is achieved between us and the Palestinians. In any case, Abu Mazen promised to uphold all of his previous commitments, and the first of these is honoring the commitment to demilitarize the areas under the control of the Palestinian government, including – of course – the Gaza Strip.

Over the weekend we also heard an interesting declaration from the Australian government of a kind that we do not always hear. It simply said that eastern Jerusalem is not occupied territory; the minimum is that is an area in dispute. To say this sharply and with such clarity and, I would say, courage, is refreshing given the chorus of hypocrisy and ignorance, ignorance not only of ancient history, but of recent and current history. What has really happened here? Who invaded who? Who occupied what? What is subject to negotiation? What is the area in dispute? These are new things. I certainly appreciate this stand by the Australian government and I am certain that all those who want to see an agreement here based on peace, justice and truth – and it is impossible to build peace based on historic lies – would agree. There is truth and it must be embraced. It requires many, many conclusions and steps, but it certainly does not require the sanctification of lies.”

1. To continue acting in accordance with its 24 April 2014 decision and to not negotiate with a Palestinian government with backing from Hamas, a terrorist organization which calls for the destruction of Israel;

2. To act, including in the international arena, against the participation of terrorist organizations in elections;

3. To authorize the Prime Minister to impose additional sanctions on the Palestinian Authority;

4. To hold the Palestinian Authority responsible for all actions that harm the security of Israel which originate in Judea, Samaria and the Gaza Strip; and

5. To form a team to consider ways of action given the new reality that has been created and ahead of diplomatic and security situations that will be created in the future.

Prime Minister Benjamin Netanyahu said:

“Today, Abu Mazen said yes to terrorism and no to peace. This is the direct continuation of Abu Mazen’s policy of refusing peace. While Israel has carried out courageous and painful steps on behalf of the diplomatic process and continues to be committed to peace, Abu Mazen has refused to extend the negotiations, has rejected the American framework document, continues to incite against Israel, has unilaterally acceded to UN treaties and has now forged a pact with the Hamas terrorist organization.

Abu Mazen has forged a pact with the Hamas organization, which is responsible for the murder of over 1,000 innocent Israelis and the firing of thousands of missiles at Israeli cities.

Abu Mazen has forged a pact with Hamas, an organization which has been declared a terrorist organization in the US, Europe, Egypt and throughout the world, and which completely rejects the international community’s conditions. The international community needs to treat it accordingly.

In recent days, the leaders of the Hamas terrorist organization have reiterated their commitment to the path of terrorism and to the elimination of the State of Israel.

The agreement with Hamas makes Abu Mazen directly responsible for the terrorism emanating from Gaza.

The State of Israel will not conduct diplomatic negotiations with a Palestinian government with backing from Hamas, a terrorist organization that calls for the destruction of Israel.”

Prime Minister Benjamin Netanyahu, made the following remarks at the start of the weekly Cabinet meeting:

“I call on all responsible elements in the international community not to run to recognize the Palestinian government of which Hamas is a part and which rests on Hamas. Hamas is a terrorist organization that calls for the destruction of Israel and the international community must not embrace it. This will not strengthen peace; it will strengthen terrorism.

On the upcoming Shavuot holiday  we see the first fruits of the Land of Israel. And we see here the first fruits of the Land of Israel. There are children here from the Negev and from Tzuba in the Jerusalem hills. I see here wheat, grapes, fruit from the ground and many other things and of course, we merit to see the children. Shavuot also marks the giving of the Torah and the bringing of the first fruits and we always knew that we have a land flowing with milk and cyber.”

The Cabinet today, unanimously decided that Israel will not negotiate with a Palestinian government backed by Hamas, a terrorist organization that calls for Israel’s destruction.

In addition, Israel will respond to unilateral Palestinian action with a series of measures.

Prime Minister Benjamin Netanyahu said:

“Instead of choosing peace, Abu Mazen formed an alliance with a murderous terrorist organization that calls for the destruction of Israel.

Abu Mazen has formed an alliance with an organization whose covenant calls for Muslims to fight and kill Jews. Hamas has fired more than 10,000 missiles and rockets at Israeli territory and has not halted terrorist actions against Israel even for a minute.

The agreement between Abu Mazen and Hamas was signed even as Israel is making efforts to advance the negotiations with the Palestinians. It is the direct continuation of the Palestinians’ refusal to advance the negotiations. Only last month Abu Mazen rejected the framework principles proposed by the United States. Abu Mazen has refused to even discuss recognizing Israel as the national state of the Jewish People. He violated existing agreements by unilaterally applying to accede to international treaties and then formed an alliance with Hamas.

Whoever chooses the terrorism of Hamas does not want peace.”

This evening, as talks are still ongoing about extending the negotiations, Abu Mazen has chosen Hamas and not peace.

Whoever chooses Hamas does not want peace.”

Prime Minister Benjamin Netanyahu, made the following remarks at the start of the weekly Cabinet meeting:

“In recent months the State of Israel has conducted negotiations with the Palestinians in order to reach a peace agreement. Israelis expect peace, a genuine peace, in which our vital national interests are assured, with security first and foremost. During these talks we carried out difficult steps and showed a willingness to continue implementing moves that were not easy, in the coming months as well, in order to create a framework that would allow for putting an end to the conflict between us. Just as we were about to enter into that framework for the continuation of the negotiations, Abu Mazen hastened to declare that he is not prepared even to discuss recognizing Israel as the national state of the Jewish People, which we have made clear to both the President of the United States and to other world leaders as well.

To my regret as we reached the moment before agreeing on the continuation of the talks, the Palestinian leadership hastened to unilaterally request to accede to 14 international treaties. Thus the Palestinians substantially violated the understandings that were reached with American involvement. The Palestinians’ threats to appeal to the UN will not affect us. The Palestinians have much to lose by this unilateral move. They will achieve a state only by direct negotiations, not by empty statements and not by unilateral moves. These will only push a peace agreement farther away and unilateral steps on their part will be met with unilateral steps on our part. We are ready to continue the talks but not at any price.”
